English: Persons with Limited Capacity
A minor's contract is rescindable, not void
Without consent it can be rescinded, but it stays valid until then.
Pure-benefit acts need no consent
Receiving an unburdened gift etc. cannot be rescinded — the minor loses nothing.
Adult ward: consent doesn't save the deal
Even with the guardian's prior consent the contract is rescindable (daily necessities excepted).
Person under curatorship: consent only for major acts
Only important acts (selling real estate, borrowing, guaranteeing) need the curator's consent.
Deception kills the right to rescind
Pretending to be an adult forfeits rescission; mere silence isn't deception.
Who receives the demand matters
A demand to the statutory agent unanswered = deemed ratified; a demand to the minor/ward themselves has no effect.
