免許・欠格事由の間違えやすいポイント
免許権者は「都道府県の数」で決まる
2以上の都道府県に事務所→国土交通大臣、1つの都道府県内→知事。事務所の数は無関係。本店は宅建業を営まなくても事務所扱い。
有効期間5年・更新は90日〜30日前
期限内に更新申請すれば、処分が遅れても旧免許は処分まで有効。
1年で必要的取消し
免許後1年以内に事業を開始しない・引き続き1年以上休業→免許権者は取り消さなければならない。
廃業等の届出は30日以内
死亡は相続人が「知った日」から30日、解散は清算人、破産は破産管財人が届け出る。届出義務者のひっかけに注意。
執行猶予中は欠格・猶予明けは即OK
執行猶予期間が満了すれば5年待たずに免許を受けられる。刑の執行終了なら5年必要との対比。
罰金で欠格になるのは暴力系＋業法違反
傷害・暴行・現場助勢・脅迫・背任・暴力団系の罪と宅建業法違反の罰金は5年欠格。その他の罪の罰金は欠格でない。
聴聞公示前60日以内の「役員」
不正手段等による免許取消しの場合、公示前60日以内に役員だった者も5年欠格。政令で定める使用人は含まれない点に注意。
破産者は復権で即復活
復権を得れば5年待たずに免許可。
未成年者は法定代理人も審査
営業に関し成年者と同一の行為能力を有しない未成年者は、法定代理人（法人なら役員含む）が欠格だと免許不可。

Prefecture count decides the authority
Offices in 2+ prefectures → Minister; one → governor. Head office always counts as an office.
5-year validity; renew 90–30 days out
A timely application keeps the old license alive until the decision.
Mandatory revocation after 1 idle year
Not starting within a year, or a full year's suspension of business, forces revocation.
Report closures within 30 days
Death: heir reports within 30 days of LEARNING of it; dissolution: the liquidator.
Suspended sentence = barred until it ends
Once probation expires, eligibility returns immediately — no extra 5 years.
Only violent-type fines disqualify
Fines for assault, injury, crowd-cheering, intimidation etc., or Brokerage Act offenses → 5-year bar; other fines don't.
Officers within 60 days of the hearing notice
On revocation for fraud etc., officers in place during the 60 days before the notice share the 5-year bar (statutory managers do NOT).
Bankrupts recover on discharge
Restoration of rights ends the bar at once — no 5-year wait.
Minors: the statutory agent is screened
A minor without full business capacity fails if their statutory agent (or its officers) is disqualified.
